July 14th, 2011 3 Reasons Why YOU Should Fight For Dr. York
On May 8, 2002 A.D., a Liberian Diplomat who is also a Ghanaian National, Dr. Malachi Kobina York, or Dr York for short, was kidnapped by the Federal Government. He was subsequently sentenced to a ridiculous amount of time, 135 years. Because of this, many have dedicated their lives to freeing Dr York from the false imprisonment of the US government.
So why should you fight for this man? Here are 3 reasons:
1. Dr. York is Innocent!!
Dr. York was falsely convicted on federal charges. The media coverage says that Dr. York committed acts of child molestation. Let’s just state this FACT. Dr. York never molested any children. And there is NO federal charge of child molestation. In order for the federal government to get involved in a case like this, there has to be evidence that supports that a crime was committed from one state to another.
So, Dr. York was accused of violations of the federal Mann Act. This law was basically set up for pimps and prostitutes who committed relative crimes in different states. The government claimed that Dr. York transported or caused to be transported children from NY to Georgia and from Georgia to Disney World for the purpose of illicit acts.
Sounds deep right? Check it! During the bond hearing, the lead FBI investigator, Juliane Ward, was asked on the stand, under oath, did she have any witnesses or evidence that Dr York transported or caused to be transported anyone for the purpose of illicit acts. Her reply was NO!! Case closed right?
Wrong. There was no reason for the federal government to be involved in the first place. What judge would sign off on a warrant for arrest for these bogus allegations when there is no evidence or witness to state that a crime was even committed? Again, WHAT JUDGE WOULD DO THIS?
2. Dr. York was set up by his attorneys!!
This is a strong claim. It has many implications. But let’s look at the facts. Early on in the case, Dr. York’s family hired the Garland firm. They are a high priced, high profile law firm who has represented many celebrities, like Ray Lewis. But are they just a money hungry firm who cares nothing for Africans in America?
In the Ray Lewis case, Ray Lewis had two co-defendants who were all accused of a murder that happened in Atlanta. Ray hired the Garland firm. What’s ironic is Ray Lewis, who struck a plea deal with the prosecution, was the only one in the case who was sentenced. The other two were found not guilty. Did the Garland firm really look out for the best interests of their client? Or did they just take the money and run while Ray Lewis has a tarnished image because of a conviction?
With Dr. York, the Garland firm initially fought. But something happened. Near the end of 2003, Dr. York ended up firing the attorney’s his family hired. Attorney Adrian Patrick became the lead attorney for Dr. York. By then, it was a few weeks before trial was to begin. Attorney Patrick discovered that with little time to prepare for trial, the Garland Firm had not interviewed one defense witness. They had not prepared to defend Dr. York at all! This is a very disturbing fact.
Is the Garland Firm a part of the ‘Good Ol’ Boy’ circle in Georgia? Are members of the Garland Firm hiding white hooded sheets in their closets? Is this why the Garland Firm likes to make plea deals for their clients? Did they intentionally put Dr. York in a position that made it hard for him to defend himself properly? I know what it looks like to me. It looks like racism to me.
3. This could happen to YOU or YOUR LOVED ONES!
One thing Dr. York has taught is that people are not concerned about a thing until it hits home. You don’t learn about cancer until you or someone you love has it. You don’t change the bad foods you eat until you get hypertension. You don’t get involved with civil injustice until you are the victim. Enough is enough.
Dr. Martin Luther King said something to the effect of Injustice anywhere is a threat to justice everywhere. This is a reality that we have long ignored. We as a people should not wait until prejudice and racism knocks on our door before we fight for change. We should take every opportunity to right the wrongs that have been committed by a system designed to perpetuate the glass ceiling socially, economically, racially, and legally. No longer should we look at obvious cases of racial bias and pretend it’s just supposed to be that way. That’s bull!!
Do you or your father have to get dragged to jail for crimes he didn’t commit just because of his race or social status before you get up and fight these grave injustices? Do they have to bury you or your loved ones in a dungeon in Florence, Colorado before you say no one should be treated this inhumanely? Do you or your loved ones have to endure a so-called public trial then have the transcripts sealed before you realize corruption is happening right before your eyes? The answer to ALL of the above questions should be absolutely not.
Most are willing to die for their loved ones. That’s not what we are asking of you. We are asking that you take a serious look at the case of Dr. Malachi Kobina York and see based on the facts of this unjust and corrupt case a reason to do something about it. As Bob Marley said, “Get up! Stand up!” Don’t give up the fight. Don’t give up on Dr. Malachi York. See what he has endured for the past 9 years and counting. If you do not do anything else, at the least, spread the word to someone else who may help. Don’t let them bury Dr. Malachi Kobina York alive! Get up, Stand up!!
